Step 3 Vote for LIUNA (if this is a necessary step)
In non-construction sectors, if at least 40% of the workers sign cards the Nova Scotia Labour Relations Board will hold a secret ballot. This vote is normally held within five days of the union’s application for certification. If the majority votes for the union, it is certified.
In the construction industry, the process is slightly different. If at least 35% but not more than 50% of the workers sign cards, the Board will order a vote.
Majority rules. But if more than 50% sign cards, the Board will certify the Union without a vote.
LIUNA Will Protect Your Rights Under Nova Scotia Labour Law
Most employers would rather not have their employees represented by a union.
But the choice is not theirs. Under Nova Scotia labour law, your employer cannot interfere with your decision to join a union. Employers can talk about the union generally but are forbidden from making any promises or threats, or to do anything that might prevent employees from making a free decision.
If your employer breaks the law, LIUNA will take legal steps to enforce your rights.
